Hemp Legalization in Panama

The production, marketing and export of hemp in Panama was legalized in January 2025 through Bill 26. The new law regulates the cultivation, harvesting, transformation, export, storage, transportation, marketing, distribution, use and possession of hemp. In Panama, hemp is defined to have a concentration of THC no higher than 1% by dry weight.

The requirements for obtaining a hemp authorization in Panama have not been established yet. It is stated in Bill 26 that these regulations should be introduced within 90 days following the new law’s promulgation.

Hemp Authorizations Available in Panama

The Ministry of Agricultural Development will be responsible for licensing the sowing, harvesting and production of hemp while the Ministry of Commerce and Industry will be responsible for licensing the transformation, manufacture of hemp derivatives and products, as well as the marketing, distribution and export of hemp.

Cultivation

A cultivation authorization allows to acquire hemp propagation material, plant and harvest hemp.

Processing

A processing authorization allows to receive harvested hemp and use it to produce a finished product for marking or export purposes.

Marketing

A marketing authorization allows to sell finished hemp products domestically or to export them.

Licensees must:

Hold a Good Agricultural Practices certification.
Test their harvested hemp to ensure that the delta-9 THC concentration does not exceed 1%.
