Hemp Legalization in Wyoming

Wyoming passed HB 171 in 2019 to align the state’s hemp regulations with the 2018 Farm Bill. The bill authorized the use and possession of hemp products containing no more than 0.3% THC.

Wyoming’s state hemp plan was approved by the USDA on February 20, 2020.

In March 2024, Wyoming banned the production and sale of hemp products containing any synthetic substances in the state, through Senate File 32. The ban became effective from July 1, 2024.

Hemp Licenses Available in Wyoming

There is only one hemp license in Wyoming – it allows to produce and process hemp.

Annual license fee: $750

To obtain a hemp license in Wyoming, the applicant must submit a complete application along with the license fee and all the required information.

Information required to be submitted with the application includes:

  • A copy of the applicant’s government issued photo identification or, for a business entity, a Wyoming Secretary of State certificate of good standing.
  • An aerial map or photograph of all the licensed areas on which the applicant intends to grow or process hemp.
  • An official Criminal History Report for all Key Participants of the applicant dated within 60 days prior to the application submission date.
  • If the applicant plans to process hemp, a description of the hemp products the applicant plans to produce and a statement of the intended end use for all hemp material received for processing.

All licenses expire on December 31 of each year.

All hemp licensees must report to the USDA Farm Service Agency the following information:

  • Hemp crop acreage.
  • Acres of hemp planted, harvested and destroyed.
  • License number.
  • Street address for each licensed area.
  • Geospatial locations of each lot or greenhouse where hemp will be produced.
  • Acreage or indoor square footage of any greenhouse where hemp is produced.

Wyoming Hemp Industry

In 2020, there were 28 licensees authorized to grow hemp on 1,058 acres outdoors and 18,150 square feet of greenhouse area. Of the licensed area, 873 acres were planted and 788 acres harvested. In 2021, Wyoming planted 850 acres of hemp according to the USDA National Hemp Report, and harvested 840 acres.

According to the USDA Hemp Public Search Tool, as of February 2025 there are 9 hemp licensees in Wyoming.
