On April 18, 2019, Senate Bill 868 was approved by Oklahoma Governor Kevin Stitt, to allow for the commercial production of industrial hemp. According to the bill legislature, SB 868 “authorizes the state Department of Agriculture to take develop and administer a production program under the 2018 federal farm bill.”

In October 2020, Oklahoma State Hemp Plan was approved by the United States Department of Agriculture (USDA).

The new state law requires separate licenses for cultivation and processing hemp. The application fee and annual renewal fee for a hemp cultivation license in Oklahoma is $500 plus an additional $5 per acre or 33 cents per square foot of greenhouse. The application fee and annual renewal fee for a hemp processor license are:

  • $1,000 for processors with annual sales below $50,000,
  • $2,000 for processors with annual sales between $50,001 and $250,000,
  • $5,000 for processors with annual sales of more than $250,000.

Hemp cultivation and processor licenses expire on December 31 of the year in which the licenses are issued.

According to the Department of Agriculture, there were 129 industrial hemp growers licensed with 3,885 acres in production in 2020 comparing to 359 growers’ licenses and 4,610 acres in 2019.

In 2021, hemp producers insured 12,189 acres and about 2,800 acres of hemp were planted.

In 2023 Oklahoma had 21 licensed hemp growers and 22 processors.
